This document is provided for operational use and must be reviewed and approved by qualified legal counsel in each jurisdiction where you operate before public launch. Nothing here constitutes legal advice.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a binding legal agreement between you and HZ Tech ("HZ Tech," "we," "us," or "our") governing access to and use of the MoveLoL marketplace, website, mobile experiences, application programming interfaces, and related services (collectively, the "Platform" or "Services"). The public brand name for the Platform is movelol.
By creating an account, clicking "I agree," posting a job, placing a bid, making a payment, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
If you use the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" includes that entity.
2. Platform Role — We Are Not a Mover
HZ Tech operates a technology marketplace that helps customers ("Customers") who need specialty moving and related services connect with independent third-party moving companies and individuals ("Movers" or "Moving Companies").
HZ Tech is not a moving company, carrier, motor carrier, freight forwarder, employer, joint employer, general contractor, subcontractor, agent, partner, or insurer of any Customer or Mover. We do not perform moves, provide labor, supply trucks, or take possession of goods.
Any contract for moving services is solely between the Customer and the Mover they select. HZ Tech is not a party to that contract except as expressly stated in these Terms regarding Platform payments, fees, and dispute-processing mechanics.
We do not guarantee the quality, safety, legality, licensing, insurance coverage, timing, pricing, or outcome of any move. Verification badges, document uploads, AI-assisted reviews, ratings, or other trust signals are provided for convenience only and do not constitute warranties or endorsements.
3. Eligibility
You must be at least eighteen (18) years old and capable of forming a binding contract to use the Services. The Services are intended for users located in the United States.
Movers must have the legal authority to operate their business, maintain any licenses and insurance required by applicable federal, state, and local law for the services they offer, and provide accurate business information.
We may refuse, suspend, or terminate any account at our sole discretion, including for failure to meet eligibility requirements or compliance standards.
4. Accounts and Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@movelol.com if you suspect unauthorized access.
You agree to provide accurate, current, and complete registration information and to update it as needed. Impersonation, duplicate accounts intended to evade restrictions, and account sharing in violation of these Terms are prohibited.
5. Customer Responsibilities
Customers are responsible for the accuracy of job postings, including descriptions, photos, addresses, access constraints (stairs, elevators, parking), item weight and dimensions, and scheduling preferences.
Customers must provide safe and lawful access to pickup and delivery locations, disclose known hazards, and be available as reasonably required on the service date.
Customers are solely responsible for securing valuables, obtaining any building or street permits, and complying with landlord, co-op, HOA, or municipal requirements.
Accepting a bid and completing payment constitutes authorization for the selected Mover to perform the described services subject to the Mover's own terms communicated to the Customer.
6. Mover and Company Responsibilities
Movers are independent businesses. Movers—not HZ Tech—set prices, determine crew size and equipment, schedule work, and perform services.
Movers must maintain valid licenses, registrations, and insurance appropriate to their services and service areas, including but not limited to state mover licenses, USDOT/MC authority where required, general liability, automobile liability, cargo, and workers' compensation or lawful equivalents.
Movers must honor accepted bids except as permitted by these Terms or as renegotiated directly with the Customer through Platform-supported flows. Movers must not solicit off-platform payment for jobs accepted for Platform checkout when prohibited by Platform rules.
Movers are responsible for their personnel, subcontractors, and equipment, and for compliance with wage, hour, tax, immigration, and safety laws.
7. Job Postings, Bids, and Acceptance
Posting a job is free unless otherwise disclosed. Movers may submit bids including price, estimated timing, proposed service windows, messages, and whether gratuity is included in the quoted price.
Customers may accept one bid per job. Until payment is completed, acceptance may not obligate the Customer to pay through the Platform.
Unverified Movers may submit bids marked as "lead only" or similar. Customers may not accept such bids for Platform checkout. HZ Tech does not guarantee that lead-only interactions will result in a completed move or payment.
Customers may edit open jobs. Movers who previously bid will be notified that job details changed and should confirm or update their bids. HZ Tech is not responsible for losses arising from outdated bids.
8. Verification and Compliance Documents
Movers may upload business registration, tax forms, licenses, insurance certificates, and related documents ("Verification Materials"). HZ Tech or its contractors may manually review materials and may use automated tools, including artificial intelligence, to assist review.
Verification is not a certification, guarantee, or warranty of legality, safety, financial solvency, or fitness for a particular job. We may approve, reject, suspend, or revoke verification at any time.
Movers must promptly update expired or inaccurate Verification Materials. Failure to do so may result in suspension from Platform checkout.
- Document requirements may vary by service metro (e.g., NYC Metro, Los Angeles, SF Bay Area) and job scope (local vs. interstate).
- AI-generated review scores and flags are reference tools for human reviewers and must not be relied upon by Customers as a substitute for their own due diligence.
9. Peek Credits and Marketplace Access
Unverified Movers may need to spend "Peek" credits to view certain job details. Peek allocations, pricing, and packs may change. Peek purchases are generally non-refundable except where required by law.
Peek grants access to information on the Platform only; it does not guarantee winning a job or Platform payment eligibility.
10. Payments, Platform Fees, and Stripe
Platform checkout is processed by Stripe, Inc. and its affiliates ("Stripe"). By paying through the Platform, you agree to Stripe's terms and privacy policy.
When a Customer pays for a job through the Platform, funds are collected by Stripe on behalf of the transaction workflow described in our Payment & Cancellation Policy. HZ Tech charges a platform fee of 12% of the transaction amount unless otherwise disclosed at checkout.
Movers receiving payouts through Stripe Connect must complete Stripe onboarding, provide accurate banking and tax information, and maintain an account in good standing. HZ Tech is not responsible for Stripe delays, holds, or account limitations imposed by Stripe or banking partners.
You authorize us to share transaction data with Stripe, payment networks, and financial institutions as necessary to process payments, refunds, chargebacks, and payouts.
11. Completion PIN and Payout Release
After Platform payment, Customers receive a completion PIN. Movers enter the PIN when the Customer confirms the job is complete. PIN entry is designed to trigger release of the Mover's net payout through the Platform's payment workflow.
The PIN is a convenience mechanism. Release of funds may still depend on Stripe Connect status, fraud review, chargebacks, disputes, or technical failures. HZ Tech does not guarantee payout timing.
Customers must safeguard the PIN. Sharing the PIN constitutes authorization that the described work was satisfactorily completed unless a dispute is opened in accordance with our policies.
12. Cancellations and Rescheduling
Cancellation and rescheduling rules are described in our Payment & Cancellation Policy, which is incorporated by reference. Policies may differ based on job status (open, awarded, paid, in progress, completed).
HZ Tech may, but is not obligated to, assist with cancellations or rescheduling. Unless required by law, service fees and platform fees may be non-refundable.
13. Refunds, Chargebacks, and Payment Disputes
Refund eligibility is limited and governed by our Payment & Cancellation Policy and applicable law. HZ Tech does not guarantee refunds for dissatisfaction with a Mover's performance.
If you initiate a chargeback or payment dispute with your bank or card issuer, we may suspend accounts, withhold payouts, and share records with Stripe and financial institutions.
Movers acknowledge that chargebacks and disputes may result in reversal of payouts, Stripe fees, and additional administrative charges to the extent permitted by law and Stripe's agreements.
14. Reviews, Ratings, and User Content
Users may submit reviews, messages, photos, and other content ("User Content"). You grant HZ Tech a worldwide, non-exclusive, royalty-free, sublicensable license to use, host, store, reproduce, modify, display, and distribute User Content for operating, promoting, and improving the Services.
You represent that you own or have rights to User Content and that it does not violate law or third-party rights. We may remove User Content at any time without notice.
Reviews must be honest and based on actual experience. We may investigate suspected manipulation, retaliation, or fake reviews.
15. Prohibited Conduct
We may investigate violations and cooperate with law enforcement. Violations may result in immediate termination and referral to authorities.
- Violating any law, regulation, or third-party right.
- Posting false, misleading, or fraudulent jobs or bids.
- Circumventing Platform fees by soliciting off-platform payment for Platform-checkout jobs.
- Harassment, discrimination, threats, or unsafe behavior.
- Uploading malware, scraping, reverse engineering, or interfering with the Services.
- Using the Services for unlawful items (hazardous materials without disclosure, stolen goods, etc.).
- Misrepresenting licenses, insurance, identity, or affiliation with HZ Tech.
- Creating accounts to evade bans, verification, or Peek limits.
16. Intellectual Property
The Platform, including software, design, logos, and trademarks, is owned by HZ Tech or its licensors. Except for limited use necessary to access the Services, no rights are granted to you.
You may not use HZ Tech's or MoveLoL's names, logos, or marks without prior written consent.
17. Third-Party Services
The Services integrate third parties including Stripe (payments), Mapbox (maps), Twilio (SMS), Resend or similar providers (email), Supabase (hosting/database), and OpenAI or similar providers (AI features). Your use of those services may be subject to their terms.
HZ Tech is not responsible for third-party outages, errors, data practices, or acts or omissions.
18. Location and Driver Tracking
Movers may optionally share live location with Customers. Location data is processed as described in our Privacy Policy.
HZ Tech does not guarantee accuracy of GPS data, continuous availability, or real-time tracking. Do not use tracking as the sole safety mechanism.
19. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, HZ TECH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
HZ Tech DOES NOT WARRANT THAT MOVERS ARE LICENSED, INSURED, QUALIFIED, OR AVAILABLE; THAT JOBS WILL RECEIVE BIDS; THAT MOVES WILL BE COMPLETED ON TIME OR WITHOUT DAMAGE; OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
YOU ACKNOWLEDGE THAT MOVING INVOLVES INHERENT RISKS, INCLUDING PROPERTY DAMAGE, INJURY, AND DELAY. YOU ASSUME RISK IN SELECTING A MOVER AND IN PREPARING ITEMS FOR TRANSPORT.
20. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HZ TECH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR PROPERTY DAMAGE ARISING FROM OR RELATED TO THE SERVICES OR ANY MOVE, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HZ TECH'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US$100) OR (B) THE TOTAL PLATFORM FEES PAID BY YOU TO HZ TECH IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
21. Indemnification
You agree to defend, indemnify, and hold harmless HZ Tech and its officers, directors, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your interaction with any other user, including any move performed or not performed; (d) your violation of these Terms or law; or (e) if you are a Mover, the acts or omissions of your employees, contractors, or crew.
22. Disputes Between Users
Disputes between Customers and Movers regarding performance, damage, pricing changes, delays, or cancellations are primarily between those parties.
HZ Tech may, but is not obligated to, provide tools to facilitate communication or resolution. Any assistance is discretionary and does not make HZ Tech a party to the underlying service contract or create additional warranties.
23. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except for small claims court matters and injunctive relief for intellectual property misuse, any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules or Commercial Arbitration Rules, as applicable.
The arbitration will be seated in Los Angeles County, California. Hearings may be conducted remotely (video or telephone) under AAA rules or by agreement of the parties; you are not required to appear in person in Los Angeles unless the arbitrator orders otherwise or applicable law requires it. The Federal Arbitration Act governs the interpretation and enforcement of this section.
YOU AND HZ TECH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
You may opt out of arbitration within thirty (30) days of first accepting these Terms by emailing legal@movelol.com with subject "Arbitration Opt-Out," your name, and account email.
24. State-Specific Notices
California residents: These Terms are governed by California law (see Section 29). You may report complaints to the California Department of Consumer Affairs. Nothing in these Terms limits non-waivable rights under the California Consumer Legal Remedies Act or other applicable law.
New York City and other New York customers: Moving services may be subject to NY consumer protection and mover regulations. HZ Tech is a technology marketplace and does not itself perform regulated moving services.
If any state requires additional terms, those terms are incorporated to the minimum extent required.
25. Electronic Communications and SMS
You consent to receive transactional communications by email, SMS, push notifications, or in-app messages related to your account, jobs, bids, payments, verification, and security.
SMS messages may be sent via Twilio or similar providers. Message and data rates may apply. Reply STOP where supported to opt out of marketing texts; transactional messages may still be sent as permitted by law.
26. Beta Features and Availability
We may label features as beta, pilot, or early access. Such features are provided as-is, may change or be discontinued without notice, and may have limited support.
We do not guarantee geographic availability, job volume, or Mover supply in any market.
27. Suspension and Termination
We may suspend or terminate your access at any time, with or without notice, for any reason, including suspected fraud, safety concerns, or violation of these Terms.
Upon termination, provisions that by their nature should survive will survive, including payment obligations, disclaimers, limitation of liability, indemnity, and arbitration.
28. Changes to Terms
We may modify these Terms at any time. We will post the updated Terms and revise the "Last updated" date. Material changes may be notified by email or in-app notice.
Continued use after changes become effective constitutes acceptance. If you do not agree, stop using the Services and close your account.
29. General Provisions
Governing Law: These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where federal law applies (including the Federal Arbitration Act).
Entire Agreement: These Terms, the Privacy Policy, and the Payment & Cancellation Policy constitute the entire agreement between you and HZ Tech regarding the Services.
Severability: If any provision is unenforceable, the remainder remains in effect.
Assignment: You may not assign these Terms without our consent. We may assign freely.
No Waiver: Failure to enforce a provision is not a waiver.
